Overview:

Welcome to the website of JS KOI Limited. By accessing or using this website, or by making a purchase, you agree to be bound by these Terms of Service, which govern your use of the site and any transactions conducted through it. These Terms apply to all users, including visitors, registered users, and customers. If you do not agree to these Terms, you should refrain from using this site.

JS KOI Limited reserves the right to update or modify these Terms at any time, and continued use of the website following any changes constitutes your acceptance of those modifications.

Use of the Website:

You may use this website for lawful purposes only. You must not misuse the website by knowingly introducing viruses or other harmful material, attempting to gain unauthorised access, or interfering with the site’s operation. We reserve the right to suspend or terminate access if we believe there has been a breach of these terms.

General Koi Purchasing Terms & Conditions (Excludes Auction Koi):

Koi with a purchase value of £500 or more may be secured with a 50% non-refundable deposit. For koi priced under £500, full payment is required at the time of purchase.

If you decide to exchange a koi before collection, this may be arranged within 14 days of purchase, provided the koi is still in our care and the replacement is of equal value. Exchanges are subject to availability and approval.

All koi must be collected or deKoi gender is not guaranteed unless explicitly stated on the purchase listing (e.g., “female guaranteed”). If a koi sold with a gender guarantee is later determined to be male, we will request appropriate verification. Once confirmed, a store credit will be issued. Please note, due to breeder limitations, no monetary refunds can be offered in these cases. This excludeds koi which are listed female or male which do not indicate 'guaranteed'.livered within one month of the purchase date. If a koi remains in our care beyond this period, a holding fee of £15 per week will apply.

While we strive to present accurate and detailed photographs of our koi, please be aware that colours may appear differently depending on your screen settings and lighting conditions. Koi are living creatures, and their colours, patterns, and intensity can change naturally over time as they mature. All images on our website represent the fish at the time the photograph was taken and are provided for reference purposes only.

We update our website regularly; however, in rare cases koi sold in person may not be reflected on the site for up to 24 hours.

Due to biosecurity and regulatory restrictions, no koi may be returned to our premises under any circumstances.

Customer Request & Japan Auctions T&C:

Koi ordered on special request or through auction bidding are individually sourced to your specifications and are not part of our standard stock. As these koi are purchased exclusively for you, full payment is required upfront. (Flexible payment options may be available for customers purchasing multiple koi).

All koi are quarantined under our strict quarantine procedure, including heat ramping cycles and necessary parasite treatments. Once quarantine is complete, koi will be kept at ambient temperature or unheated and fed minimally to maintain optimal water quality.

Koi can remain with us free of charge until 31st March 2026. After this date, a £15 per week holding fee will apply.

While we take every possible care, JS Koi cannot be held responsible for any natural changes in appearance or quality while koi are in our care. Should a koi die during quarantine or before collection, a credit note or refund to original payment method will be issued for the amount paid.

As these koi are purchased on special request, responsibility for the purchase rests with the customer. As these koi are purchased on special request, responsibility remains with you, the customer. JS Koi is here to source and provide quarantine services for your koi. If you no longer wish to proceed after confirmation, you are responsible for finding a new buyer. No refunds or returns can be offered for a change of mind.

Genders are not guaranteed unless specifically marked as “Female Guaranteed.” If a female-guaranteed koi is later proven to be male, suitable evidence will be required. Upon verification, a credit note will be issued. Refunds cannot be provided, as breeders in Japan do not guarantee gender accuracy.

For biosecurity reasons and in compliance with UK regulations, no koi may be returned to our premises under any circumstances.

The deposit amount will be confirmed at the time of order. The remaining balance is due once the koi has arrived and completed quarantine, unless otherwise agreed in writing.

Overwinting Koi:

From November 3rd onwards, koi may be overwintered at JS KOI by prior arrangement. While we maintain high water quality and appropriate husbandry practices, we cannot accept responsibility for any changes in condition, colour, or overall appearance while the koi remain on-site. In the rare event that a koi dies while under our care during the holding period, a credit note will be issued for use on a future purchase.

Overwintered koi must be collected or dispatched by April 1st. Any koi held beyond this date will again be subject to the £15 weekly care fee.

Koi Auction Information:

Each auction runs for a four-day period and can be accessed via the Auction section of our website.

Bidding Process:

Each auction will commence with a designated starting bid, determined individually for each koi fish. Starting bids may vary—commonly set at, but not limited to, £1, £10, or £100—based on factors including, but not limited to, quality, size, variety, and rarity. All bids must exceed the current highest bid to be considered valid and will be binding upon submission.

Please note that all bids are final and legally binding. Once placed, bids cannot be withdrawn during or after the auction. We encourage all participants to carefully consider their bids, especially when bidding on multiple lots, as it is possible to win more than one koi.

Auction Extension (Popcorn Bidding):

To promote fairness and reduce last-second "sniping," our auctions feature an auto-extend function. If a bid is placed within the final two minutes of an auction, the closing time will automatically extend by another two minutes. This system—often referred to as popcorn bidding—is a common feature in Japanese koi auctions and reflects the "fair warning" approach used in traditional live auctions.

Payment and Confirmation:

Successful bidders will receive a confirmation email shortly after the auction ends. Full payment must be completed within 48 hours of auction close. Failure to complete payment may result in account suspension and disqualification from future auctions. Please note discount codes are not valid for koi won in auction.

Holding Terms & Condition of Koi

Once purchased, koi can remain at our facility free of charge for up to one month. After this period, a weekly upkeep charge of £15 will apply. While we take every care in maintaining the health and condition of the koi during this time, JS KOI cannot be held responsible for any injury, illness, or deterioration in quality. If you win multiple auctions, you will receive a single invoice by email that includes all your winning bids, so you'll only be charged one delivery fee.

Should a koi unexpectedly pass away while in our care, a full refund equivalent to the purchase amount will be issued.

Please note that auction koi are sold as-is and cannot be returned, exchanged, or refunded under any circumstances. To support optimal water quality and reduce pre-transport stress, sold koi are maintained in unheated systems and provided with minimal feeding during the holding period.

Delivery & Collection:

Delivery of koi is available within the United Kingdom and is not included in the purchase or auction price. A flat delivery fee of £29.95 applies per shipment. If multiple koi are won or purchased, this single delivery charge still applies. Alternatively, koi may be collected from our facility by prior arrangement at no cost.

We dispatch koi on Wednesdays, Thursdays, and Fridays. It is your responsibility to ensure someone is present to receive the delivery. We are not liable for missed deliveries or delays caused by courier services once the koi have left our facility.

Dry Goods:

All dry goods are offered subject to availability and may be withdrawn or substituted without notice. Prices are listed in GBP and may be adjusted at our discretion. Items must be stored in a cool, dry place out of direct sunlight. JS KOI Limited cannot be held responsible for any damage caused by improper storage or misuse.

Orders for dry goods must be paid in full before dispatch. Returns are accepted within 14 days of delivery, provided the goods are unused, in original packaging, and accompanied by proof of purchase. We are not responsible for delivery delays caused by third-party couriers or unforeseen circumstances beyond our control.

Discounts, Promotions, and Gift Cards:

JS Koi may offer promotional discount codes, special offers, or gift cards from time to time. The following terms apply unless otherwise specified:

Discounts and Promotions:

• Eligibility: Discounts may be limited to one use per customer and are only valid for individual, non-transferable accounts.

• Exclusions: Discount codes cannot be applied to sale items and cannot be combined with other discount codes or promotions.

• Expiration: Each discount code is valid only for a specified time period, as stated in the promotional details. Expired codes will not be accepted.

• Non-Transferability: Discount codes have no cash value, are non-refundable, and may not be resold or transferred.

• Right to Modify: JS Koi reserves the right to modify, suspend, or cancel any promotion or discount code at any time without prior notice.

• Misuse: Misuse of promotional offers—such as creating multiple accounts or violating usage restrictions—may result in cancellation of the discount and/or suspension of the account.

Gift Cards:

• JS Koi offers electronic gift cards (e-gift cards), which are delivered via email to the recipient provided at the time of purchase.

• E-gift cards are valid for one (1) year from the date of purchase, unless otherwise required by law.

• E-gift cards are non-refundable, cannot be exchanged for cash, and may not be used to purchase other gift cards.

• Lost, deleted, or incorrectly entered email addresses are the responsibility of the purchaser. JS Koi is not responsible for lost or misdirected e-gift cards.

• Use of e-gift cards constitutes acceptance of these terms.

Account and Eligibility:

To participate in koi auctions or place orders through our website, you must register with a valid name, address, and contact details. You are responsible for maintaining the confidentiality of your login credentials. Any misuse of your account or breach of these Terms may result in immediate suspension.

Accuracy of Information:

We strive to ensure that product descriptions, prices, and availability are accurate, but errors may occur. We reserve the right to correct any inaccuracies and to cancel or refuse orders if information is found to be incorrect, even after an order has been submitted.

Intellectual Property:

All content on this website, including images, text, logos, graphics, and software, is the property of JS KOI Limited or our licensors and is protected by intellectual property laws. You may not copy, reproduce, or exploit any content without prior written permission.

Third-Party Links:

This website may contain links to third-party websites or tools. We do not endorse and are not responsible for the content or practices of these third parties. Use of third-party services is at your own risk and subject to their respective terms and privacy policies.

User Submissions and Feedback:

If you provide suggestions, reviews, or other content, you grant us the right to use, reproduce, and distribute such material without restriction. We reserve the right, but are not obligated, to monitor or remove content we consider inappropriate, unlawful, or misleading.

 Disclaimer of Warranties:

 Limitation of Liability:

To the fullest extent permitted by law, JS KOI Limited shall not be liable for any indirect, incidental, or consequential damages arising from the use of our website or products. This includes, but is not limited to, loss of profit, data, or business interruption.

Indemnity:

You agree to indemnify and hold harmless JS KOI Limited, its directors, employees, and affiliates from any claims, damages, or expenses arising from your breach of these Terms or your misuse of the website.

Severability:

If any provision of these Terms is found to be unlawful or unenforceable, the remaining provisions shall remain in full force and effect.

Termination:

We reserve the right to terminate or suspend your access to the site and services without notice if we believe you have violated these Terms. Upon termination, any obligations or liabilities incurred prior to termination shall survive.

Entire Agreement:

These Terms of Service, together with our Privacy Policy and any other legal notices posted on the site, constitute the entire agreement between you and JS KOI Limited and supersede any prior agreements or understandings.

Governing Law:

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the English courts.

Force Majeure:

JS KOI Limited shall not be held liable for any failure or delay in performance arising from circumstances beyond its reasonable control. These include, but are not limited to, natural disasters, acts of God, government restrictions, wars, pandemics, labour disputes, power failures, internet outages, or other events beyond our control that make it impractical or impossible to fulfil obligations.

Dispute Resolution and Jurisdiction

These Terms, and any separate agreements under which we provide services, shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising in relation to these Terms shall be subject to the exclusive jurisdiction of the English courts.
